TERMS AND CONDITIONS


  1. Instructions on how to claim and the rewards form part of these Terms and Conditions. By participating in this promotion, claimants are deemed to have accepted these Terms and Conditions. This offer is not valid in conjunction with any other offer.
  2. The promoter is Alcon Laboratories (Australia) Pty Limited (ABN 88 000 740 830) of 54 Waterloo Road, Macquarie Park, NSW 2113, telephone 1800 025 032 (“Promoter”).
  3. Claims are only open to Australian and New Zealand residents. Entrants under 18 years old must have parental/guardian consent to enter this promotion.
  4. Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to claim. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  5. Promotion commences on 01/05/2017 and ends at 11:59pm AEST on 31/07/2017, or when cash backs have been exhausted, whichever is first to occur (“Promotion Period”).
  6. To be eligible to claim, individuals must complete the following steps during the Promotional Period:
    1. purchase either: (i) any two (2) or more Dailies Total 1 family of lenses 90-pack products (or six (6) or more Dailies Total 1 family of lenses 30-pack products) in a single transaction from a participating retailer; OR (ii) any four (4) or more Dailies Total 1 family of lenses 90-pack products (or twelve (12) or more Dailies Total 1 family of lenses 30-pack products) in a single transaction from a participating retailer (“Qualifying Transaction”); and then
    2. Visit www.egiftcardpromo.com, follow the prompts to the promotion claim page, complete the claim form with all of the requested details (including but not limited to their full name, mailing address, and email address), upload a copy of their original itemised tax invoice/receipt for the Qualifying Transaction issued by their optometrist (that clearly shows the purchase date, invoice number and products purchased), and then submit the fully completed claim so it is received during the Promotional Period. Individuals will receive a claim ID at the time of submitting their claim, which they can reference at any time for the status of their claim.

    For the removal of doubt, frequent replacement lenses (monthly or bi-weekly lenses) will not be eligible for this promotion. A participating retailer will be any retailer in Australia and New Zealand that displays advertising material for this promotion.

  7. Subject to the total limit of AUD$200,000 worth of virtual gift cards, claimants will be eligible to receive the following:
    1. Claimants who make a Qualifying Transaction of any four (4) or more Dailies Total 1 family of lenses 90-pack products (or twelve (12) or more Dailies Total 1 family of lenses 30-pack products) will be awarded a AUD$150 virtual Visa Gift Card, which will be issued via email. A 2.99% foreign exchange conversion fee applies to transactions in any currency other than Australian dollars made with the gift card; this is calculated on the Australian dollar transaction amount and is taken from the virtual Visa Gift Card account at the time of purchase; and
    2. Claimants who make a Qualifying Transaction of any two (2) or more Dailies Total 1 family of lenses 90-pack products (or six (6) or more Dailies Total 1 family of lenses 30-pack products) will be awarded a AUD$50 virtual Visa Gift Card, which will be issued via email. A 2.99% foreign exchange conversion fee applies to transactions in any currency other than Australian dollars made with the gift card. This is calculated on the Australian dollar transaction amount and is taken from the virtual Visa Gift Card account at the time of purchase.

    For the avoidance of doubt, once a total of AUD$200,000 worth of gift cards has been claimed, no further gift cards will be awarded and the promotion will be closed.

  8. Claimants will be notified by email whether or not they are successful. Successful claimants will then receive the virtual Visa Gift Card by email within twenty four (24) hours of receiving the initial successful notification email.
  9. Prepaid Virtual Visa Accounts must be activated online within one (1) month of the email date and will expire six (6) months from activation. The Virtual Visa account can only be used in shopping environments where a physical card is not required (online, over the phone or mail order). It cannot be used for face to face transactions at merchants, financial institutions or ATMs. The account cannot be used to make transactions that exceed the available balance. For such a transaction you need to pay the difference by another method if the site or merchant agrees. Account is valid for six (6) months from the date of on-line activation or when the entire value has been exhausted, whichever occurs first. At expiry, the remaining available balance will be forfeited. A valid email address and voucher number are required during the registration process. The Virtual Visa is supplied first in a claim code for redemption. Recipients are directed to https://virtualvc.com.au to redeem their Virtual Visa, providing both the claim code received via email and personal details. Once registered, a 16-digit Account number will be displayed on the account activation screen and the account's expiry date and CVV2 security code will be emailed to the email address provided. If the 16-digit account number is lost, the recipient must keep the original Virtual Visa code and the DOB, surname and postcode they activated their code with, in order obtain the account number again. Prepaid Virtual Visa Accounts that have not been activated within one (1) month, or accounts that expire after the six (6) month validity period, will not be replaced, extended or refunded. A 2.99% foreign exchange conversion fee applies to transactions in any currency other than Australian dollars and is calculated on the Australian dollar transaction amount. This will be included in the total transaction amount debited to the account.
  10. Incomplete or indecipherable claims, or any claims received after the Promotional Period has ended (including once a total of AUD$200,000 worth of gift cards has been claimed), will be deemed invalid by the Promoter.
  11. Only one (1) claim is permitted per person.
  12. Claimants must upload their original itemised tax invoice/receipt to their claim form as proof of purchase. Failure to produce the proof of purchase when requested may, in the absolute discretion of the Promoter, result in invalidation of a claimant’s claim and forfeiture of any right to a reward. The purchase receipt must clearly specify the store of purchase, that the required number of eligible products was purchased, and that the purchase was made during the Promotional Period but prior to claim submission. The Promoter recommends that individuals retain a copy of their purchase receipt for their own records, in the event any issues that might arise with their purchase or product.
  13. The Promoter reserves the right, at any time, to verify the validity of claims and claimant’s (including a claimant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the claim process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  14. If there is a dispute as to the identity of a claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the claimant.
  15. The Promoter’s decision is final and no correspondence will be entered into.
  16. If for any reason a claimant does not take a reward by the time stipulated by the Promoter, then the reward will be forfeited.
  17. If any reward is unavailable, the Promoter, in its discretion, reserves the right to substitute the reward with a reward to the equal value and/or specification, subject to any written directions from a regulatory authority.
  18. Rewards, or any unused portion of a reward, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
  19. Total gift pool valued at AUD$200,000.
  20. Claimants consent to the Promoter using their name, likeness, image and/or voice in the event they are a successful claimant (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  21. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  22. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia or any statutory consumer guarantees as provided under consumer protection laws in New Zealand (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  23. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in reward value to that stated in these Terms and Conditions; (e) any tax liability incurred by a claimant; or (f) taking/use of a reward.
  24. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities and where required by Law. Should disclosure of entrants’ PI to an international recipient be required, this will only be permitted when the Promoter has ensured that both parties comply with current Legislation including the Australian Privacy Principles in the handling of this information. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be accessed by contacting the Privacy Officer at privacy.australia@alcon.com. Claiming is conditional on providing this PI. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant. The Privacy Policy also contains information about how claimants may opt out, access, update or correct their PI, how claimants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.
  25. The laws of Australia apply to this promotion to the exclusion of any other law. Claimants submit to the exclusive jurisdiction of the courts of Australia.
